Whilst we endeavour to ensure that the information on this website is correct, we do not warrant its completeness or accuracy; nor do we commit to ensuring that the website remains available or that the material on the website is kept up-to-date.

We warrant to registered users who have paid a fee to us in respect of their listings that we will provide then paid-for website services with reasonable care and skill.

Subject to this, and to the maximum extent permitted by applicable law we exclude all representations, warranties and conditions.

Nothing in these terms of use shall exclude or limit our liability for fraud, for death or personal injury caused by our negligence, or for any other liability which cannot be excluded or limited under applicable law.

Subject to this, and to the extent that the information on this website is provided free-of-charge, you acknowledge that it would be unreasonable to hold us liable in respect of this website and the information on this website, and we hereby exclude all such liability.

In addition, and subject to the first paragraph of this Clause 5, we will not be liable for any consequential, special or indirect loss or damage arising under these terms of use or in connection with our website, whether arising in tort, contract, or otherwise; nor will we be liable for any loss of profit, contracts, business, goodwill, data, income, revenue or anticipated savings arising under terms of use or in connection with our website, whether direct or indirect, and whether arising in tort, contract, or otherwise; nor will we be liable for any for any loss or damage arising out of any event or series of events beyond our reasonable control.

Access to certain areas of our website is restricted.

We reserve the right to restrict access to other areas of our website, or indeed our whole website, at our discretion.

If we provide you with a user ID and password to enable you to access restricted areas of our website or other content or services, you must ensure that that user ID and password is kept confidential. You accept responsibility for all activities that occur under your user ID or password.

We may disable your user ID and password in our sole discretion.

(7) Listings

In order to list your eco-friendly products and/or eco design services on our website, you must complete our online registration form and agree to our Terms of Use and Privacy Policy.

After you have completed the online registration form, we will email to you a user ID and password which you may use to activate your account. After you have activated your account, you will be able to list products and/or add services on our website if (and only if) you have paid for listings.

The terms and conditions relating to paid listings will be as stated on our website from time to time. We may vary those terms and conditions in our sole discretion at any time by amending the descriptions on our website.

All payments for listings must be made via Paypal quarterly in advance. Paid listings will be available within 48 hours of our receipt of the relevant payment.

You account/listings will be removed in the event that you do not pay your quarterly renewal fee on the due date. An invoice will be emailed to you 30 days prior to the due date for renewal and email reminders will be sent if payment has not been received on the due date.

You warrant that the material that you submit to the website, and its use by us in accordance with these terms, will not:

breach any third party's intellectual property rights or other legal rights;
breach any applicable laws or regulations or relevant codes of practice (including the ASA Codes); and
give rise to any cause of action against any person in any jurisdiction.

You warrant that all descriptions of your products and/or servicces on the website are accurate, fair and not misleading, and that the eco-benefits ascribed to your products listed on the website are properly ascribed, having regard to the descriptions of those benefits on the website.

You further warrant that products you list on the website as discounted are properly so listed.

(8) Breaches of these terms

Without prejudice to our other rights under these terms of use, if you breach these terms in any way, or if we reasonably suspect that you have breached any of these terms in any way, we may:

delete or edit any of your listings;
send you one or more formal warnings;
temporarily suspend your account and/or your access to the website;
delete your account with the website and/or permanently prohibit you from using the website;
block computers using your IP address from accessing the website;
contact your internet services provider and request that they block your access to the website; and/or
bring court proceeding against you for breach of contract or otherwise.

Where we suspend or prohibit your access to the website or a part of the website, you must not take any action to circumvent such suspension or prohibition (including without limitation using a different account).

(9) Indemnity

You will indemnify us and keep us indemnified against any losses, damages, costs, liabilities and expenses (including without limitation legal expenses and any amounts paid by us to a third party in settlement of a claim or dispute on the advice of our legal advisers) incurred or suffered by us arising out of any breach by you of any provision of these terms of use, or arising out of any claim that you have breached any provision of these terms of use.

We may revise these terms of use from time-to-time. Please check this page regularly to ensure you are familiar with the current version.

(11) Entire agreement

These terms of use, together with our privacy policy, constitute the entire agreement between you and us in relation to your use of our website, and supersede all previous agreements in respect of your use of this website.

(12) Law and jurisdiction

These terms of use will be governed by and construed in accordance with English law, and any disputes relating to these terms of use shall be subject to the exclusive jurisdiction of the courts of England.
